Answer: After that, like I say, usually we’re able to get some of all of the evidence dismissed. If we can’t get it all, then what I generally like to do is, let’s get it reduced; let’s get as much as we possibly can thrown out so the prosecution has less that they are able to bring up in future. And after that, that is when we basically determine whether or not we need to take the case to a trial—which usually I recommend trial by jury with a DUI—or if we need to try to work out a plea. After that motion to suppress, that’s when we make that determination for the last time.
